Reservations may be subject to applicable lodging, service, amenity, pet and other fees disclosed at the time of booking. Optional services requested after booking are subject to the applicable charge communicated at the time the service is requested.

Applicable reservation charges will be reflected in the reservation folio.

Additional charges may be assessed for damage, excessive cleaning, unauthorized occupants or pets, late checkout, lost keys or access devices, missing or damaged property, rule violations, fines or assessments attributable to the stay, or other costs caused by the Renter or persons associated with the reservation.

Pets are not permitted in accommodations designated as non-pet-friendly. Unauthorized or unregistered pets are subject to a $350 violation fee per stay. This fee is separate from any applicable standard pet fee and does not authorize a pet to remain in a non-pet-friendly accommodation. Additional documented damage, excessive cleaning, or other costs attributable to the pet may be charged to the extent they are not already covered by the violation fee.

Pets should not be left unattended when doing so could result in damage, excessive noise, disturbance or unsafe conditions.

To the fullest extent permitted by applicable law, the Renter, for the Renter and to the extent the Renter is legally authorized to do so for persons under the Renter’s care or supervision, voluntarily assumes the risks associated with participation in recreational activities at Lake Simtustus Resort and releases Simtustus Lake LLC and its officers, employees and authorized representatives from claims for personal injury, death or property damage arising from the inherent risks of such recreational activities or from the Renter’s or another participant’s use or operation of golf carts, recreational vehicles, watercraft or recreational equipment, except to the extent liability cannot lawfully be waived or released.

The Renter accepts responsibility for the Renter’s own conduct and for ensuring that minors and other persons under the Renter’s supervision comply with applicable safety requirements.

Nothing in this section is intended to release or limit liability that cannot legally be released or limited under applicable law.

Certain equipment rentals or activities require a separate rental agreement, safety acknowledgment and/or liability waiver. When a separate waiver is required, completion of the Vacation Rental Agreement or acceptance of these Terms & Conditions does not replace that requirement.

Rental equipment may include boats, kayaks, canoes, paddleboards, golf carts or other recreational equipment offered by SLL from time to time.

Damage, loss, late return or failure to return rental equipment may result in additional charges according to the applicable rental agreement or Rentals Policy.

25. RENTAL EQUIPMENT WEATHER POLICY

Boat and other watercraft rentals operate rain or shine unless conditions make operation unsafe.

Rental fees are generally non-refundable due solely to rain, clouds, temperature, smoke or other undesirable weather or environmental conditions when the equipment can still be safely operated.

If lightning, severe weather or another condition makes continued operation unsafe, SLL may delay departure, require early return, suspend operations or cancel the rental.

When SLL determines that conditions prevent safe operation entirely, the affected rental may be refunded or otherwise adjusted according to the Lake Simtustus Resort Rentals Policy.

When unsafe conditions shorten an otherwise usable rental period, SLL may prorate or otherwise adjust the affected rental as appropriate.

Wildfire smoke and air-quality conditions will be evaluated based upon actual operating conditions. Smoke or air-quality concerns do not independently guarantee a refund or credit unless SLL determines that conditions prevent safe operation or suspends the affected rental activity.

No-shows and rentals forfeited because of guest failure to arrive or comply with rental requirements are non-refundable.

Smoking is prohibited inside all lodging accommodations, furnished RV rentals, glamping accommodations and other enclosed Resort facilities designated as non-smoking. This prohibition includes vaping and electronic smoking devices..

Charges are subject to applicable law.

27. FIRES, GRILLS & OUTDOOR COOKING

SLL cannot guarantee weather, lake conditions, water quality, fishing conditions, recreational access or uninterrupted utility, system or amenity service.

Travel Protection is recommended for guests concerned about circumstances that may affect their trip.

32. PARKING, VEHICLES & TRAILERS

Renters and visitors must drive slowly and cautiously throughout Lake Simtustus Resort.
